General Terms and Conditions of Sale
Article 1 – Subject Matter
The following General Terms and Conditions of Sale govern the offer and sale of products appearing on the website www.tittex.com, owned by Spugnificio Meridionale s.r.l. Registered office and factory: S.P. Trani-Andria km 5+500, 76125 Trani (BT), ITALY. VAT number 05460630725.
Products purchased on the WEBSITE are sold directly by Spugnificio Meridionale s.r.l.
For purchases made by Customers who are traders, wholesalers, retailers or professionals, and who are purchasing for non-personal use, the purchase transactions shall be governed by the provisions of the Civil Code.
Data protection shall be governed by the legislation set out in REGULATION (EU) 2016/679 and Legislative Decree 101/2018. To this end, the Customer must read the “Privacy Policy” available on the website and give their consent to the processing of their data in order to proceed with the order.
Article 2 – Acceptance of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale and the Privacy Policy must be reviewed by Customers of the website before completing the order. Proceeding with the order therefore implies full knowledge of and acceptance of these terms; without reading and accepting them, the order cannot proceed.
By placing an order, the Customer declares that they have read and accepted all the general terms and conditions of sale and payment set out herein, and further declares that they have read the Privacy Policy carefully and in full, are fully aware of its contents, and have given their consent to the processing of their personal data; By submitting their purchase order, the Customer therefore accepts these terms unconditionally and undertakes to comply with them in full, together with the payment terms.
This Website is aimed at a general audience; however, its services are intended for persons aged 18 or over. Spugnificio Meridionale s.r.l. does not deliberately request, collect, use or disclose personal data provided by persons under the age of 18. Should Spugnificio Meridionale s.r.l. become aware that it has collected data from a minor, it will delete such data.
If you are under the required age, please do not proceed with any online purchases or service requests, and ask an adult (such as your parents or guardian) who has the legal capacity to access and enter into binding contracts and who has a valid email address.
Spugnificio Meridionale s.r.l. reserves the right not to process orders from individuals who do not meet the requirements set out in the preceding points.

Spugnificio Meridionale s.r.l. guarantees that its website, WWW.TITTEX.COM, is protected in accordance with international Internet standards. Provided the website is used correctly, the user is protected from the risk of viruses.
Spugnificio Meridionale s.r.l. accepts no liability for any malfunctions arising from the deactivation of cookies in the user’s browser.
Spugnificio Meridionale s.r.l. reserves the right to amend or review the terms and conditions contained in this legal notice by updating it whenever it deems appropriate, without any obligation to give prior notice.
The user must comply with the terms set out in this legal notice, checking periodically for any updates, amendments and corrections.
Article 3 – Purchasing Procedures
Purchases of the available products, as illustrated and described online on the relevant pages, are made by the Customer at different prices depending on whether the Customer holds a VAT number or not.
If the Customer holds a VAT number, purchases of available products are made at the current price indicated, excluding taxes and duties, which will be added to the shopping basket and increased by delivery charges (if applicable) and, in any case, displayed at the time of purchase.
If the Customer does not hold a VAT number, purchases of the available products are made at the current price indicated, which already includes taxes and duties, plus any delivery charges (where applicable), all of which are displayed at the time of purchase.
Product availability is updated based on the number of items in stock; as access to the website and the ability to place orders online affect product availability, Spugnificio Meridionale s.r.l. does not guarantee that the goods ordered will be allocated; In any case, the Customer is also given the option to reserve certain products, for which Spugnificio Meridionale s.r.l. reserves the right to inform the Customer of delivery times (which may be longer than standard delivery times) and availability, either by email or by telephone.
Before the purchase is confirmed, the Customer will be shown a summary of the unit price of each selected product, the total per line item, the total cost of the order where multiple products are purchased, and any delivery charges.
Once the Customer has completed their purchase order, they will receive an initial email in which Spugnificio Meridionale s.r.l. simply confirms receipt of the order, quoting the relevant order number; in the following days, and approximately within the next two working days (although this timeframe is not binding), Spugnificio Meridionale s.r.l. will send a further email to the Customer to confirm acceptance of the order, confirming dispatch of the product(s) to the address provided and giving the Customer an estimated delivery time. Upon receipt of these emails, the Customer may check that the details and the products purchased are correct and, if necessary, report any issues and/or request further information by emailing info@tittex.com or by calling the following number: 0883 509697.
The Customer may check the status of their order in the customer area.
Orders may have the following statuses:
AWAITING PAYMENT: if the Customer has made payment by bank transfer, the payment is pending verification before the order can be confirmed. The customer is required to email a copy of the payment to pagamenti@tittex.com within 48 hours of receiving the order confirmation. If Spugnificio Meridionale s.r.l. does not receive a copy of the payment within this period, it will cancel the order.
CONFIRMED: the order has been completed by the customer and payment has been verified. If authorisation is not granted by the international banking network, the order is automatically cancelled;
WAITING FOR DISPATCH: the order is awaiting verification by Spugnificio Meridionale s.r.l. (immediate availability or in stock);
DISPATCHED: the products relating to the order have been handed over to the courier responsible for delivery.
Article 4 – Payment Methods
Payments in instalments are not permitted.
If the Customer has chosen to pay using the credit cards available and listed online, payment must be made at the time of placing the order. The payment provider automatically verifies the validity of the card at the time of ordering and sends an email confirming the outcome of the transaction; the payment is actually collected by Spugnificio Meridionale s.r.l. upon dispatch of the goods.
Prices are subject to change at any time, but such changes do not affect orders already confirmed in the manner described above.
If the credit card issuer or our service provider refuses, or for any reason fails to authorise or validate the payment, Spugnificio Meridionale s.r.l. shall not be liable for any delays or non-delivery.
In the absence of the information required to complete the payment, Spugnificio Meridionale s.r.l. reserves the right to automatically cancel the order.
At no stage during the purchase process is Spugnificio Meridionale s.r.l. able to access the purchaser’s credit card details, credit card number or the Customer’s financial, asset-related or personal information. This information is, in fact, transmitted via a secure connection directly to the bank’s or financial institution’s portal at the time of the customer’s confirmation. Spugnificio Meridionale s.r.l. is therefore in no way liable and cannot be held responsible for any fraudulent or unlawful use of credit cards that may be carried out by third parties during the purchase and payment process for the products.
If the Customer has chosen to pay via PayPal, upon completion of the order, they will be redirected to the PayPal login page. The amount relating to the order will be debited from the PayPal account at the time the order is processed. In the event of the order being cancelled either by the Customer or in the event of non-acceptance by Spugnificio Meridionale s.r.l., the amount will be refunded to the Customer’s PayPal account. In the event of order cancellation, a request will be made to cancel the transaction, and Spugnificio Meridionale s.r.l. shall under no circumstances be held liable for any direct or indirect damages caused by a delay in the release of the amount held by PayPal. For every transaction carried out via a PayPal account, the Customer will receive a confirmation email from PayPal. Spugnificio Meridionale s.r.l. reserves the right to cancel and/or suspend the order should PayPal send an email reporting anomalies and/or irregularities in the payment; in such cases, Spugnificio Meridionale s.r.l. reserves the right to request further information from the Customer and/or copies of documents proving ownership of the card used. In the absence of the required documentation, Spugnificio Meridionale s.r.l. reserves the right not to accept the order, without this giving rise to any right on the part of the Customer to claim damages.
If the Customer has chosen to pay by cash on delivery, they should bear in mind that this service incurs an additional charge of €5 and cannot be used for orders exceeding €2,999.99. Upon delivery, the Customer must pay the courier the exact amount of the order, as the courier cannot give change. Only cash is accepted.
Should the Customer cancel an order placed using a credit card, bank transfer or PayPal, Spugnificio Meridionale s.r.l. will issue a refund via the same payment method chosen by the Customer, who may not request a change to this method.
Article 5 – Delivery
Spugnificio Meridionale s.r.l. accepts orders for delivery within Italy, the European Union and non-EU countries.
The delivery charge, to be added to the price of the products purchased, is calculated automatically by the system, except for deliveries to the European Union and non-European countries, in which case Spugnificio Meridionale s.r.l. reserves the right to provide the exact amount following order confirmation.
The Customer is required to check, upon receipt, whether the number of parcels delivered corresponds to that indicated on the consignment note, whether the packaging is intact, and whether the product delivered to them complies with the order placed; The Customer must sign the delivery note, stating “subject to verification of the integrity of the products”; if this is not done, the Customer may not, after delivery, raise any objection regarding the external non-conformity of the ordered product or its quantity.
Without this imposing any obligations on Spugnificio Meridionale s.r.l., the goods are delivered, as a rule, within 10 working days of the order confirmation being sent, subject to verification that payment has been made in full and correctly. In the case of orders paid for by means other than an advance bank transfer, where Spugnificio Meridionale s.r.l. has received reports of payment anomalies (such as, for example, a discrepancy between the name of the registered account holder and the credit card holder), the products will be delivered within 10 working days from the date on which the payment is verified as valid, or in any event from the completion of any checks required to verify the validity of the payment. Should the products not have been delivered within 15 working days of the order confirmation being sent, the Customer may send an email to info@tittex.com with the subject line ‘non-delivery’, stating the order number and any relevant notes. Upon receipt of the email and following the necessary enquiries, Spugnificio Meridionale s.r.l. will contact the Customer within 2 working days to resolve the issue or to explain the reasons why the order has not been dispatched.
Article 6 – Returns and Refunds
Spugnificio Meridionale s.r.l. allows goods to be returned within 14 days of delivery in the event of discrepancies with the order and/or product defects.
The cost of returning the goods, due to discrepancies from the order and/or product defects, shall be borne by Spugnificio Meridionale s.r.l. and shall be handled by a carrier appointed by Spugnificio Meridionale s.r.l.
In any case, the Customer has the right to withdraw from the contract for any reason within 14 days of delivery of the goods. In the latter case, the cost of returning the goods shall be borne entirely by the Customer and will be handled by a designated carrier appointed by Spugnificio Meridionale s.r.l. The cost of the return shipment will be deducted from the refund for the returned goods. This right applies only to consumers who do not hold a VAT number.

Your notification must specify whether the return is due to a defect (please attach photos) or a withdrawal, which products are being returned, the date of purchase and your chosen method of refund.
The product, together with all its original contents, must be packed in the original boxes (plastic wrapping, etc.) to protect them from damage.
Return requests will not be accepted more than fourteen days after delivery.
Article 7 – Jurisdiction and Competent Court
The sales contract is governed by Italian law.
The Court of Trani shall have exclusive jurisdiction over any dispute relating to the validity, interpretation or performance of this contract.
Article 8 – Amendments
The terms and conditions contained in this document may be amended by Spugnificio Meridionale s.r.l. without prior notice and shall take effect from the date of publication on the website www.tittex.com
